Privacy Policy

Jack’s (“we,” “us,” “our”) operates the pre-launch waitlist and referral program at americanjacks.com (the “Service”). This policy explains what personal information we collect, why we collect it, and the choices you have. By creating an account, you agree to the practices described here.
1. What we collect
- Account information: your email address and your name, if you choose to provide it.
- Age certification: the timestamp of your 21+ certification at signup. This certification governs waitlist eligibility only. Any future age/identity verification will be handled by a dedicated verification provider under its own privacy policy.
- Referral data: your unique referral code, who referred you (if anyone), and the status of your referrals and any promotional credit.
- Attribution data: UTM parameters and referral source, so we know how members found us.
- Usage and analytics events: page views, signup steps, referral-link copies, referral signups and qualifications, and credit unlocks — used to operate and improve the Service.
- Device and network data: IP address and basic device/browser information, used for fraud and abuse prevention (for example, detecting bot signups and duplicate accounts).
We collect this information directly from you when you use the Service, and automatically through cookies and similar technologies described below.
2. How we use it
- Operate the waitlist and your membership account.
- Attribute referrals and administer promotional credit.
- Send transactional emails: sign-in links, welcome messages, and referral/credit notifications.
- Measure, analyze, and improve the Service.
- Detect and prevent fraud, abuse, and automated signups.
- Comply with legal obligations, including age-restriction laws that apply to our product category.
We do not use your information for third-party advertising, and we do not make automated decisions with legal effect based on it.
3. What we don’t do
We do not sell your personal information, and we do not share it with advertisers or data brokers. Your email address is used for Service communications only and is never published or displayed to other members.
4. Who we share it with
We share personal information only with vetted service providers who need it to operate the Service, and only the data they need:
- Hosting and infrastructure (Vercel).
- Database hosting (PostgreSQL).
- Authentication services (Auth.js).
- Transactional email delivery (Resend).
A future age/identity verification provider will process verification data under its own terms and privacy policy. We may also disclose information when required by law, to protect the safety and integrity of the Service, or to enforce our Terms.
5. Cookies
We use a small number of cookies, all for operating the Service:
- Sign-in session cookies — strictly necessary to keep you signed in.
- Referral-attribution cookie — remembers whose referral link you followed for 30 days, so a later signup in the same browser is still attributed.
- Signup cookie — short-lived, remembers your signup preferences (such as UTM parameters) while you complete signup.
We do not use third-party advertising or cross-site tracking cookies. Disabling cookies may prevent sign-in and referral attribution from working.
6. Data retention
We retain account data while your account is active and for a reasonable period afterward for fraud prevention, dispute resolution, and legal compliance, then delete or anonymize it. Analytics data is retained in aggregated form. You may request deletion of your account and personal data at any time by contacting privacy@americanjacks.com; we will delete it unless we are required to retain it by law or for legitimate fraud-prevention purposes.
7. Your rights
Depending on your jurisdiction — including California residents under the CCPA/CPRA — you may have the right to know what personal information we hold about you, to request a copy, to correct inaccuracies, to request deletion, and to opt out of certain sharing. We will not discriminate against you for exercising these rights. To exercise them, contact privacy@americanjacks.com and we will respond within the timeframes required by law.
8. Security
We use industry-standard administrative, technical, and physical safeguards to protect personal information — including encrypted connections, signed session tokens, and access controls on our systems. No system is perfectly secure, so we cannot guarantee absolute security. Please notify us promptly of any suspected unauthorized access to your account.
9. 21+ only — no children’s data
The Service is not directed to anyone under 21, and we do not knowingly collect personal information from individuals under 21. Anyone who indicates they are under 21 is blocked from creating an account, and accounts found to belong to under-21 individuals are deleted along with their personal data.
10. Changes to this policy
We may update this policy as the Service evolves. We will notify members of material changes before they take effect, and the updated policy will show a new “last updated” date.
