Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Jack’s (“we,” “us,” “our”) governing your use of the pre-launch waitlist and referral program at americanjacks.com (the “Service”). By creating an account, you agree to these Terms. If you do not agree, do not create an account or use the Service.

1. Pre-launch membership

Jack’s is a members-only retail club built around transparent cost-plus pricing. The Service is currently in pre-launch: it offers a waitlist and a referral program only. The full store has not launched. A pre-launch account provides waitlist access and referral participation only, and does not guarantee future membership, pricing, product availability, or launch timing. We may change, delay, or cancel the launch at our discretion.

2. Eligibility — 21+ only

The Service is exclusively for adults 21 years of age or older. To create an account you must certify that you are 21 or older. That checkbox certification governs waitlist eligibility only: it does not, by itself, satisfy legal age-verification requirements for purchases. Before you may purchase any age-restricted products — or redeem any promotional credit — we will require age and identity verification through a dedicated verification provider. Accounts found to belong to individuals under 21 will be terminated and their data deleted.

You must also be a resident of the United States, and you may maintain only one account per person. Accounts must be created with your own valid email address.

3. Your account

You are responsible for the security of your sign-in (your email inbox, which receives your magic sign-in links) and for all activity under your account. Provide accurate information, keep it up to date, and notify us promptly at legal@americanjacks.com of any suspected unauthorized access. You may not create an account on behalf of someone else, share accounts, or use another person’s identity.

4. How cost-plus pricing works

Jack’s intends to offer members products priced at our cost plus a clearly disclosed markup, instead of traditional retail markups. Any cost, markup, or price figures shown before launch are illustrative examples only — not offers to sell. We reserve the right to set final pricing, markups, membership terms, and product assortment at launch.

5. Referral program

Pre-launch members may earn promotional Jack’s store credit under the Referral Program Terms, which are incorporated into these Terms by reference. Merely sharing a referral link does not earn a reward; rewards are earned only as described in the Referral Program Terms.

6. Promotional credit

Any Jack’s credit issued under the referral program is promotional store credit only. It has no cash value and cannot be withdrawn, transferred, sold, or redeemed for cash. Credit is usable only after Jack’s launches, subject to launch availability and the store’s terms at that time, and may carry an expiration date disclosed before launch. Credit obtained through fraud, abuse, or violation of these Terms will be voided.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful, fraudulent, or abusive purpose.
• Create accounts by automated means, use bots or scripts, scrape the Service, or send spam.
• Create duplicate accounts, use false identities, or misrepresent your age or identity.
• Refer yourself, create fake referrals, or otherwise manipulate referral attribution, qualification, or rewards.
• Interfere with the security or proper operation of the Service, including attempts to circumvent age-verification or anti-abuse systems.

8. Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in fraud or abuse, attempt to circumvent our systems, or if we discontinue the Service. On termination, your access ends immediately; any unearned or pending referral rewards are forfeited, and promotional credit obtained through abuse is voided. You may close your account at any time by contacting privacy@americanjacks.com.

9. Intellectual property

The Service — including the Jack’s name, wordmark, site design, and content — is our property or the property of our licensors. You may not copy, reproduce, distribute, or create derivative works from it without our prior written permission.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not make health or safety claims about any products, and nothing on this site should be read as such a claim. We do not guarantee uninterrupted, error-free operation of the Service.

11. Limitation of liability

To the maximum extent permitted by law, Jack’s and its owners, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability for any claim arising from the Service will not exceed $50.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms as the Service evolves toward launch. We will notify members of material changes before they take effect, and continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
